A shisha lounge owner was ordered to pay out more than £1,500 by the courts yesterday (Tuesday 4 July), after allowing smoking inside the premises.

Saqib Altaf Hussain, owner of Breeze Shisha Lounge in John Street, Sheffield, pleaded guilty to an offence committed on 12 November 2016, for allowing smoking to take place indoors.

He had been charged with failing to prevent smoking in a smoke-free place, contrary to section 8 of the Health Act 2006.

Magistrates in Sheffield yesterday ordered him to pay out a total of £1,535 – made up of a £250 fine, a £35 victim surcharge and costs of £1,150.

This is the second time Hussain, aged 44, has been before the courts, after being prosecuted for the same offence in July 2015.

Councillor Bryan Lodge, Cabinet Member for Environment and Streetscene at Sheffield City Council, said: “It’s disappointing that the defendant has continued to overlook the advice of our officers and allowed smoking of shisha pipes at his premises.

“As a result, he was rightly back before the courts this week. Venues must be smoke-free, and that includes shisha lounges.

“The law is clear on this and if a business is operating as a shisha café, the premises must meet the necessary requirements..”

This latest prosecution follows a number of similar successful cases brought before the courts by Sheffield City Council’s Health and Safety Enforcement Team.

Just last month, another shisha lounge owner was fined nearly £3,000 for allowing customers to smoke shisha pipes inside premises that should be smoke-free – and this was, again, despite an earlier prosecution for the same offence.

Sheffield City Council regularly inspects businesses to make sure they are compliant with smoke-free regulations.

The authority also works closely with partners at organisations including South Yorkshire Police, the Safeguarding Children Board, South Yorkshire Fire and Rescue, HMRC and the UK Border Agency to ensure the safety and health and wellbeing of the public.
